The Affirmative Asylum Process

To begin the process, you must file Form I-589, Application for Asylum and Withholding of Removal, to the U.S. Citizenship and Immigration Services (USCIS). The USCIS will review your application and schedule you for an interview with an Asylum Officer, who will determine your eligibility for asylum and decide whether to grant or deny your asylum request. If they deny your application, they will forward your case to a judge who will conduct a hearing and make a decision independent of the USCIS.
