San Jose Affirmative Asylum Attorney

Providing Compassionate Legal Representation

If you are a foreign national currently in the United States and are unable or unwilling to return to your home country because you have been persecuted or have a well-founded fear of persecution on the basis of race, religion, nationality, political opinion, or membership in a social group, then you may be eligible to apply affirmatively for asylum with USCIS.

A knowledgeable attorney can guide you through the asylum process to ensure you complete all necessary paperwork and submit your application on time. The Law Offices of Timothy D. Widman solely focuses on immigration cases, and Attorney Widman has over 20 years of experience helping individuals with various legal matters. He is prepared to provide the legal guidance you need.

The Affirmative Asylum Process

To begin the process, you must file Form I-589, Application for Asylum and Withholding of Removal, to the U.S. Citizenship and Immigration Services (USCIS). The USCIS will review your application and schedule you for an interview with an Asylum Officer, who will determine your eligibility for asylum and decide whether to grant or deny your asylum request. If they deny your application, they will forward your case to a judge who will conduct a hearing and make a decision independent of the USCIS.

It is important to work with a lawyer during the application and hearing processes. An attorney can provide legal advice to help you present your case and seek a favorable decision. Attorney Widman will work one-on-one with you to get a firm grasp of your situation and explain your best course of action.
