Categories of Family Preference Visas

Whether the family member seeking residency in the United States is currently in the country or will undergo consular processing while in the native country, the process will proceed in a similar manner. There are four categories that family members fall into, based on the immigration law of the United States.

The four preference categories include:

  • 1st Preference – Adult unmarried children over age 21.
  • 2nd Preference – Spouses of legal permanent residents. Must be unmarried children or grandchildren of legal permanent residents.
  • 3rd Preference – Sons and daughters of U.S. citizens who are married. Also includes their minor children and spouses.
  • 4th Preference – Siblings of adult U.S. citizens. Also includes their minor children and spouses.
