Adjustment of status is extremely important for immigrants, as it allows them to become lawful permanent residents in the United States. Like most aspects of immigration, however, it can take months to receive an affirmative answer from the United States Citizenship & Immigration Services (USCIS). Those who retain an immigration attorney may have a significant advantage over others who apply.

How Do I Apply for Adjustment of Status?

The first step in applying for adjustment of status is for a relative, who is a citizen or lawful permanent resident, to file form I-130. An employer may also file form I-140 for the same purpose. The request is typically filed with USCIS and the applicant must demonstrate admissibility. However, inadmissibility can result in a denial of the request by USCIS.

Grounds of inadmissibility can include:

  • Health-related grounds
  • Security-related grounds
  • Criminal grounds
  • Public charges
  • Lack of proper documentation

After being admitted to permanent residence, the non-citizen is permitted to remain in this country indefinitely, provided they follow the rules applied to immigrants of this status. Those who apply are also expected to understand the legal requirements necessary for obtaining a visa and are typically required to attend an interview with a USCIS officer. Without preparing correctly, the interview can be difficult and many immigrants have to try a second time. Don't let this happen to you!

Make the Smart Choice.
