Categories of Family Preference Visas

The exact process you use to obtain a family-based green card will depend on your current location. If you are in the U.S. lawfully, you will need to adjust your status to permanent residence, which you can do without leaving the country. If you are not yet in the U.S., you will need to apply for an immigrant visa through consular processing, and you will present this visa at a U.S. port of entry. If CBP allows you into the U.S., you will receive your green card in the mail.

There are four categories that family members fall into, based on the immigration laws of the United States.

The four preference categories include:

  1. Adult (21 and older) unmarried children of U.S. citizens.
  2. Spouses and unmarried children of lawful permanent residents. Children under 21 have a higher preference within this category than those who are 21 or older.
  3. Married children of U.S. citizens.
  4. Siblings of U.S. citizens (citizens must be 21 or older).
